Dossier: AVV

Extended producer responsibility (EPR) for electrical and electronic equipment has been in existence for 25 years. Stichting OPEN plays a key role, as a non-profit management organization, for the implementation of the EPR. The agreements on how Stichting OPEN implements the EPR are laid down in a waste management contribution agreement (ABBO) that has been declared universally binding by the government, the so-called AVV. The current AVV of the collective system for electrical and electronic devices and lamps, assigned to Stichting OPEN, expires and needs to be renewed.

Why is an AVV important?

Every producer and importer of electrical and electronic equipment and lamps in the Netherlands has a statutory producer responsibility, including achieving a statutory collection percentage. In addition, a well-functioning nationwide collection system must be ensured, efficient and high-quality processing of discarded electrical appliances and lamps and the results achieved must be reported annually to the government. The

AVV guarantees the financial basis for the implementation of the legal obligations and serves to finance the collection and recycling system of discarded electrical appliances and lamps.

Fair distribution of costs and an affordable system

Only if every producer and importer contributes can a nationwide collective collection and recycling system be efficiently maintained. This is guaranteed with a Universally Binding Declaration that ensures that all producers and importers have to pay a waste management contribution to cover the costs. This ensures a level playing field. The current AVV ends on 31 December 2025 and given the duration of the procedure, a new request for AVV will be submitted to the government on 1 April 2025. The aim is to have a new AVV that will enter into force on 1 January 2026.

New application for AVV

With a new AVV, the OPEN Foundation can continue to carry out the producer responsibility collectively in an efficient manner on behalf of all producers and importers. A collective through the OPEN Foundation has a number of advantages:

    An AVV provides a uniform obligation for all producers and importers, regardless of their size, thus avoiding distortions of competition.

    The principle of ‘level playing field’ is central. The waste management contribution is distributed proportionally and fairly among participants and ensures that companies can meet their responsibilities.
  • Compliance with legislation
    The OPEN Foundation has the expertise and resources to ensure that statutory tasks are complied with. You don’t have to worry about the complex regulations or reporting obligations to the government.
  • Contributing to a circular economy
    By participating in the OPEN Foundation, you contribute directly to a circular economy. We work with municipalities, collectors and recyclers to recover as many raw materials as possible and prevent waste.
  • Focus on your products
    By having your producer responsibility carried out by us, you can focus on what you do best: doing business. We ensure that the collection and recycling chain runs smoothly and professionally.

By agreeing to the new application for the AVV by clicking on yes (or no) via the statement in the MyOpen system, you do or do not agree that the OPEN Foundation collectively fulfils the individual producer responsibility on behalf of you and your company. Your company is completely unburdened and all producers and importers contribute equally.
